By accessing or using Tiffany Smart’s website, automation platform, or WhatsApp integration services, you agree to these Terms of Service. If you do not agree, please discontinue use of our services.

2. Service Description

Tiffany Smart offers AI-powered business process automation, chatbots, and messaging management via WhatsApp and other channels. Services are designed for business and enterprise use.

3. Account Responsibilities

Users are responsible for maintaining confidentiality of their credentials and ensuring all activity under their account complies with these Terms and with WhatsApp’s Business Policy. You agree not to use Tiffany Smart’s platform to send spam, unauthorized messages, or restricted content.

4. Ethical Conduct and Integrity

Tiffany Smart S.A.S. conducts all operations under principles of integrity, respect, and transparency. We maintain a Code of Ethics that prohibits bribery, corruption, and unfair business practices. All employees and partners are required to act in good faith and in compliance with this code.

5. SARLAFT / Anti-Money Laundering Policy

Tiffany Smart S.A.S. implements preventive controls under the SARLAFT framework (Circular Básica Jurídica de la Superintendencia de Sociedades). We are committed to preventing and detecting: • Money laundering and terrorism financing. • Transactions with unverified or high-risk clients. • Use of our platform for illegal activities. We apply a Know Your Customer (KYC) approach for our corporate clients and keep monitoring mechanisms for suspicious activity.

5. Ownership and Intellectual Property

All software, documentation, branding, and content made available by Tiffany Smart S.A.S. remain the property of Tiffany Smart S.A.S. You may not copy, modify, distribute, or create derivative works without written permission.

6. Payment and Subscription (if applicable)

If your use of Tiffany Smart involves paid plans or enterprise subscriptions, billing terms will be governed by your service agreement or invoice. All payments are non-refundable unless stated otherwise.

7. Limitation of Liability

Tiffany Smart S.A.S. is not liable for indirect, incidental, or consequential damages arising from the use or inability to use the service. We do not guarantee uninterrupted availability or error-free operation. Maximum liability shall not exceed the total amount paid by the user in the 12 months preceding the claim.

8. Security Policy

We ensure the confidentiality, integrity, and availability of all systems. Our information security framework includes: • Role-based access control. • Encryption of communications and stored data. • Backup and recovery procedures. • Periodic audits and vulnerability testing.

10. Termination

Tiffany Smart may suspend or terminate your access at any time for violation of these Terms or any applicable law. Upon termination, your right to use the services will immediately cease, but obligations related to confidentiality and payment will remain in effect.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Colombia. Any dispute shall be resolved before competent courts in Medellín, Colombia.
